Property owners have constitutional protections against unreasonable searches. These protections extend to a variety of fire service activities, including administrative searches for code inspection and enforcement purposes, as well as criminal searches for arson investigations. In this session, Sam Light, Deputy Executive Director/General Counsel of CIRSA, will provide an overview of legal rights and risks related to fire officials’ exercising a right of entry. This presentation will include a survey of case law, relevant real-life scenarios, and suggested risk management practices. This presentation will focus on administrative search standards but also touch on standards related to criminal arson investigations
